All goods supplied by R.V. Astley LLP (the Company) are subject to the following terms and conditions:

Formation of contract

All contracts made by the Company are subject to these conditions and terms of trading to the exclusion of all terms contained in any document issued by the customer.
Orders will not be processed without written confirmation either by fax or post.

Trading terms

R.V. Astley LLP reserves the right to review prices, terms, product ranges and finishes at any time, and therefore these are subject to alteration without notice. Orders are accepted at prices and terms ruling from date of despatch.

Trade Prices

Prices in our published price list are quoted in pounds sterling and do not include VAT. VAT will be charged at the rate applicable on the date of the invoice.

Web Order Minimum is £350.00 plus Vat 
Minimum Order is £500.00 which is to include carriage.
Export Minimum Order is £1000.00, ex. works.

Deliveries

Standard lead-time is 28 days, unless otherwise stated.
All deliveries are made Monday to Friday between 9am and 5.30 pm. All deliveries must be signed for. If there is no one to sign for the delivery the carrier will leave notification and it will therefore be the responsibility of the recipient to contact the delivery company and make further arrangements.
Carriage is extra and non-refundable.
All statements and terms relating to delivery and rates of delivery are estimates only and shall not impose any contractual obligation on R.V. Astley LLP. Although we aim to deliver by a specific date we cannot accept any liabilities for fitters charges etc, if we, or our carriers, fail to do so and orders are only accepted on this basis.

Terms of Payment and passing of property

All customers are dealt with on a proforma basis until a trading relationship has been established. All account invoices must be paid in full no later than the specified due date. Should our account fail to be paid according to the afore going terms we reserve the right to levy a compound interest charge on the amount outstanding at a rate of 5% per month from the date of invoice until payment is received.
Ownership of all goods shall remain in the Company until full payment has been received for all goods comprised in this contract. If any of the goods are resold before payment is made in full the Company's right to ownership shall be transferred to the proceeds of sales or to the claim for such proceeds.
In the event of dishonoured cheques the Company reserve the right to pass on any bank charges incurred. If the customer is in default as regards payment under the terms of this contract, the company may terminate the account facility and use proforma payment, suspend deliveries until payment is made, instigate legal proceedings as deemed are necessary to recover any outstanding amounts.

Use of goods

These goods are supplied on the condition that they will not be used as articles for use at work or substances for use at work as defined by Section 53(1) Health and Safety at Work, etc., Act 1974 unless the company is notified in writing prior to the making of this contract and the customer shall, if called upon to do so, enter into a written undertaking as to their use in the form prescribed by the company.

Internet Sales 

Images from our website can only be used with written consent from R.V. Astley LLP.  We do not permit any customers to advertise, promote or sell R.V. Astley LLP items on Ebay or any other auction website.  Any customers wishing to place R.V. Astley LLP products on either their own or third party websites must apply for written permision for each item to be displayed.  The use of multi retailler sites with shopping carts is not permitted.

Guarantee

The Company will replace or, (at it's opinion) refund the invoice value of the goods supplied by it under this contract which fail in normal use and service and which are returned to the company within twelve months from the date of invoice. Save as expressly herein provided and save in respect of death or personal injury resulting from the negligence of the Company the Company shall be under no liability for, or in respect of, any defect in or failure or unsuitability for any purpose of the goods or any part thereof whether the same be due to any act, omission, negligence or wilful default of the company or its servants or agents or to faulty design, workmanship of material or any other cause whatsoever. This warranty is in lieu of and excludes all other warranties and conditions expressed or implied whether under common law statute or otherwise.

Returns and Disputed Goods

Any shortages, damages or discrepancies must be notified to the Company within 3 days of receipt. Credit/replacement goods will not be entertained after this period.
Disputed goods must be returned to R.V. Astley LLP within 7 working days of receipt.
The Company does not accept any goods for return unless consent has been expressly given. If a return is agreed the Company reserves the right to levy a restocking fee of 20% of the net goods value with a minimum charge of £20. Refunds will be issued as credit notes.
The company does not accept damage claims that have resulted in the misuse of the product.

The customer will meet delivery costs incurred by the customer returning goods and under no circumstances will the Company accept any postage and packaging or delivery costs incurred by the customer on returned goods.

All goods supplied by the Company are handmade and hand painted; the Company cannot therefore accept any responsibility for slight variations in colour, size or shape.
